Description
Summary:Folk Customs as Collective Self-representations (About a Possible Extra Message of Legal Ethnography): Contrary to the created/written right which is the product of authorship, abstract/general thinking, the folk customs - and thus the legal as well - are experice phenomena originate from a pragmatic problem-solving practice. As a law, as a part of law or as its replacement, the essence of it is conflict prevention and management. In the spirit and practical wisdom of all this, in its psychological heaviness, more or less in focusing on prevention, reparation or retaliation, and in all other aspects, the different characteristics of the peoples appear in a primary indirect intimacy. Legal Ethnography reserach thus has to reach its real task after leaving behind collections as its basic task and trying to process the material theoretically for a deeper reflection of ourselves, our past and ours, (and applying the old term as a conceptual experiment) to a kind of renewed national characterology.
